By using www.constructionjobballoon.com ("the Site") and the on-line recruitment and services ("Services") the person to whom the details within a CV/Job Seeker record refer or the person, business or company to whom copies of CVs are made available and/or to whom Services are provided by CORAL INTERNET LTD. under these Terms ("You") agree to be bound by the Terms governing this Site and the Services. If You do not agree to the Terms then You are not authorised to use the Site and the Services. Your use of the Site and the Services will be deemed acceptance of the Terms. Coral Internet Limited ( "CORAL INTERNET LTD. ") may from time to time revise the terms, Coral Internet Ltd. therefore advises that You read this page periodically to review the Terms, because any changes will be binding on You.
A person to whom the details within a CV or Job Seeker record refer is a “Job Seeker”. The person, business or company to whom copies of CVs are made available and/or to whom Services are provided by CORAL INTERNET LTD.under these Terms is a “Recruiter”. Any person, business or company that does not undertake or is not in a similar business to the Recruiter or CORAL INTERNET LTD.and the Recruiter intends to submit or does submit a CV or Job Seeker information and is seeking to employ a person in a position similar to that which the Job Seeker (in the opinion of the Recruiter or Job Seeker) is seeking a position is known as the “Employer”. A “CV” is a curriculum vitae or resume.
You are authorised to view and use the Site and the Services, provided it is for lawful purposes relating to seeking employment, information, or advertising solutions. You may not use the Site for any other purposes to transmit, distribute, store or destroy any material posted on this Site. You ensure that any information that You send to CORAL INTERNET LTD.or to any advertiser, it is accurate and legal. You are prohibited from;
- Posting any material that may infringe any personal right, copyright, moral right, database right, trade mark, patent or any other intellectual right held by any party;
- Posting any material that contains any viruses, worm or Trojan horse so as to cause any disruption to the Site;
- Posting any material that contains any data, image or otherwise which is offensive, obscene or indecent or capable of being offensive, obscene or indecent;
- Posting any incomplete, false or inaccurate information, or information that is not your own;
- Posting any franchise, pyramid scheme or setting up any other business opportunity.
CORAL INTERNET LTD.shall not be obliged to issue any credit or make any refund in respect of charges relating to the Services.
CORAL INTERNET LTD. Services purchased on an Upfront basis are non-refundable and non-transferable.
If You breach any provision of these Terms, CORAL INTERNET LTD. may at any time terminate any contract for Service with You with immediate effect.
CORAL INTERNET LTD. shall have the right at its sole discretion to modify, withhold or remove any advertising material submitted by You without liability to you, in order to comply with these Terms.
You shall use CVs and Job Seeker information received from CORAL INTERNET LTD. for the sole purpose of endeavouring to locate suitable employment on behalf of Job Seekers in accordance with their wishes by introducing such Job Seekers to Employers and providing Employers with a copy of their CV from time to time. And the Recruiter shall be responsible for ensuring its Employers use the CV data and Job Seeker information in accordance with these Terms.
You will not use any contact details in any CV or Job Seeker Record to promote the services of another company or business, or any other services that you offer. This obligation also relates to Job Seeker Records and CVs received in direct response to an advertisement placed on CORAL INTERNET LTD. .
You acknowledge that You are responsible for acts or omissions of Your employees, contractors or agents, and that CORAL INTERNET LTD. is entitled to charge for any job postings made to CORAL INTERNET LTD.’s website which are made on behalf of You by Your employees, contractors or agents, even if the employee, contractor or agent is subsequently shown to have made a mistake or have failed to carry out Your instructions correctly.
Intellectual Property
The contents of the Site and all other web sites that are under CORAL INTERNET LTD.'s control are protected under UK copyright and are the property of CORAL INTERNET LTD. CORAL INTERNET LTD. does not grant any licence or other authorisation to any user of its trademarks, service marks, or other copyright works or intellectual property.
Data Protection/Privacy
CORAL INTERNET LTD. are registered with the Data Protection Commissioner and in accordance with the Data Protection Act 1998 follows security procedures for the storage and disclosure of information, which You have given to CORAL INTERNET LTD.. Any personal information that You provide will be treated as confidential information by CORAL INTERNET LTD.. You agree to comply with your obligations under the Data Protection Act 1998.
Please note that any information that You provide to a third party will not be covered by CORAL INTERNET LTD.'s Privacy Statement.
Liability
CORAL INTERNET LTD. wants to provide as full a service as possible to recruiters posting job opportunities and services and for Job Seekers posting CVs. CORAL INTERNET LTD. does not make any checks as to the vacancies offered nor is CORAL INTERNET LTD. able to confirm the accuracy of information that any user provides.
CORAL INTERNET LTD. excludes all liability in connection with any information that is provided by both advertisers, recruiters and candidates (Job Seekers).
CORAL INTERNET LTD. shall use its reasonable endeavours to ensure that the Site has satisfactory functionality, however
CORAL INTERNET LTD. cannot guarantee that the Site will be operational at all times, and as a result will not be liable for any failure or inability to provide a continuous, error free service.
CORAL INTERNET LTD. does not make any representation whatsoever about any job postings or advertisements, which are accessed through the Site or via a link to another website.
CORAL INTERNET LTD. shall use its reasonable endeavours to ensure that the material on this website is accurate, but cannot accept any liability for the same as CORAL INTERNET LTD. relies on information provided to it by third parties.
CORAL INTERNET LTD. advises that You must satisfy yourself as to the suitability of any Job Seeker, recruiter, employer or job found through the Site. Notwithstanding anything else contained in the Terms or on the Site, CORAL INTERNET LTD. shall not have any liability to You in connection with the Agreement howsoever arising in respect of loss of profits or contracts or for special, indirect or consequential loss or damage, or for any increased costs or expenses. You agree to defend, indemnify and hold harmless CORAL INTERNET LTD. and its affiliates harmless from any and all claims, actions, proceedings, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your use of the Site and / or the Services.
CORAL INTERNET LTD. shall not be liable to You for any direct, indirect, consequential, special or other damage to your computer systems or viruses, worms, trojan horses or other destructive methods, howsoever caused, resulting from use of the Site.
Termination
You agree that CORAL INTERNET LTD. has the right at any time to deny or restrict access to the Site or access to third party services. CORAL INTERNET LTD. shall not have responsibility to inform any third party providers of services of restricted or denied access.
General
No variation or alteration to the Terms are valid or have any effect. The Terms shall constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the subject matter of the Terms.
You may not assign any of your rights and obligations under the Terms.
Nothing in the Terms shall oblige CORAL INTERNET LTD. from discontinuing the Site or any other services provided through the Site at some future date. If any of the provisions are held invalid, illegal or unenforceable for any reason, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if the Terms had been executed with the invalid provision eliminated. In the event of a holding or invalidity so fundamental as to prevent the accomplishment of the purpose of the Terms the parties shall immediately commence good faith negotiations. The provision of these Terms are the sole and entire agreement between You and CORAL INTERNET LTD. relating to the business. The Terms shall be governed, construed and shall take effect in accordance with the Laws of England; and shall be subject to the exclusive jurisdiction of the English courts.
